1. Introduction

Welcome to Realty on Record ("the Website" and "the Platform"), operated by Portal Technology Distributors cc (17 Shinz Street, Windhoek, Namibia). By accessing or using our website, mobile application, and related services, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the platform or make any payments through it.

2. Services

Realty on Record provides digital utility management, metering, monitoring, and billing services for properties and tenants. Through the Platform, users may create an account, link a utility meter or account, view consumption, and purchase prepaid credit top-ups and vouchers for electricity and water through our secure online payment gateway. Payments are applied as prepaid credit or voucher tokens to a specific meter or utility account nominated by the user.

3. Eligibility

• You must be at least 18 years old or have parental/guardian consent.
• You must provide accurate and complete information when registering and when nominating a meter or account to top up.
• You agree not to impersonate another person or provide false identity information.

4. Payment Terms

• All payments are processed in Namibian Dollars (NAD) unless otherwise indicated.
• Payments are securely handled through our authorised third-party payment gateway.
• Once a payment is successfully processed, a confirmation and a prepaid credit or voucher token will be issued and a receipt sent to the registered email address.
• It is your responsibility to ensure the meter or account nominated for a top-up is correct; credit applied to an incorrectly nominated meter may not be recoverable.
• Realty on Record does not store or have access to full card details.

5. Payment Options Accepted

Payment may be made by Visa and Mastercard credit or debit card through our secure online payment gateway, or by bank transfer into the Portal Technology Distributors cc bank account, the details of which will be provided on request.

6. Card Acquiring and Security

Card transactions are acquired for Portal Technology Distributors cc via Transaction Junction, the approved payment gateway for Namibian Acquiring Banks. Transaction Junction uses the strictest form of encryption, namely Secure Socket Layer (SSL), and no card details are stored on this website.

7. Customer Details Separate from Card Details

Customer details are stored by Portal Technology Distributors cc separately from card details, which are entered by the cardholder on the payment gateway's own secure site and are never received or held by Realty on Record.

8. Delivery and Fulfilment

The Platform delivers digital utility credit and voucher tokens only — no physical goods are shipped. Subject to availability and successful receipt of payment, prepaid credit or voucher tokens are processed and delivered electronically, ordinarily immediately or within a few minutes of a successful payment, with confirmation sent by email to the registered address. Where a token cannot be delivered, we will assist in resolving the issue or, where applicable, refund the payment in accordance with our Refund, Return & Cancellation Policy.

9. Refunds, Returns, and Cancellations

Please refer to our Refund, Return & Cancellation Policy. In summary:

• Prepaid credit top-ups and voucher purchases are generally non-refundable once the credit or voucher token has been generated or applied to a meter or account, except where a duplicate payment occurs or a payment is charged without a token being issued.
• Refund requests must be submitted to connect@portal-tech.co with proof of payment and the relevant meter or account details.
• No physical goods are shipped or returned; the service delivers digital utility credit and voucher tokens only.

10. Merchant Outlet Country and Transaction Currency

The merchant outlet country at the time of presenting payment options to the cardholder is Namibia. The transaction currency is the Namibian Dollar (NAD).

11. Responsibility

Portal Technology Distributors cc takes responsibility for all aspects relating to transactions made on this website, including the sale of the services offered, customer service and support, dispute resolution, and the delivery of digital utility credit and voucher tokens. Questions relating to a transaction should be directed to us in the first instance at connect@portal-tech.co.

12. Service Availability and Utility Supply

Utility supply (electricity, water, and gas) is provided by the relevant municipal or utility provider, property owner, or landlord. Realty on Record facilitates metering, monitoring, billing, and prepaid payment, but does not generate or guarantee the supply itself. Access to the Platform or supply may occasionally be interrupted due to maintenance, technical issues, supply outages, or circumstances beyond our control.

13. User Responsibilities

• Use the website and app only for lawful purposes.
• Do not engage in fraudulent activity, unauthorised access, or data tampering.
• Maintain the confidentiality of your account information.
• Ensure all provided details (including meter, account, and payment details) are accurate and current.

14. Limitation of Liability

Realty on Record acts as a facilitator between utility or municipal providers, property managers, and customers. We are not responsible for:

• Interruptions, outages, or changes to utility supply, supply quality, or tariffs determined by third parties.
• Credit applied to an incorrectly nominated meter or account due to inaccurate information provided by the user.
• Any loss or damage arising from the use of, or inability to use, a utility service.

To the maximum extent permitted by law, Portal Technology Distributors cc and its representatives shall not be liable for any indirect or consequential damages arising from the use of our platform.

15. Data Protection and Privacy

Portal Technology Distributors cc shall take all reasonable steps to protect the personal information of users. Your personal data is collected and processed in accordance with our Privacy Policy, which complies with applicable Namibian data protection regulations. By using the site, you consent to the collection, storage, and use of your information for account management, communication, metering, billing, and payment purposes.

16. Intellectual Property

All content on this website and app, including logos, designs, and software, is owned by or licensed to Portal Technology Distributors cc. You may not copy, distribute, or modify any materials without prior written consent.

17. Variation

Portal Technology Distributors cc may, in its sole discretion, change this agreement or any part thereof at any time. The current version published on this website applies to each transaction at the time it is made.

18. Governing Law, Domicile & Disputes

This website is governed by the laws of the Republic of Namibia. Portal Technology Distributors cc chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 17 Shinz Street, Windhoek, Namibia. In the event of a dispute, users are encouraged to contact us directly at connect@portal-tech.co. If unresolved, the matter shall be subject to the jurisdiction of the competent courts of Namibia.

This website is run by Portal Technology Distributors cc, a close corporation based in Namibia trading as Realty on Record, with registration number CC/2005/1681, and is situated at 17 Shinz Street, Windhoek, Namibia.

20. Acceptance

By proceeding with a top-up, voucher purchase, or any payment on Realty on Record, you confirm that you have read, understood, and agreed to these Terms and Conditions, as well as our Refund, Return, and Cancellation Policy.
